“FROM THE WYOMING REPUBLICAN PARTY”

Oct 14, 2020The following resolution related to COVID-19 was brought before the WY GOP State Central Committee Meeting this weekend:

Resolution on Freedom to Make Healthcare Decisions
WHEREAS, the Wyoming Constitution declares the ability to make healthcare decisions for oneself and one’s children a right as stated in Article 1, Section 38. Wyoming Constitution Article 1, Section 38 Right of health care access.

(a) Each competent adult shall have the right to make his or her own health care decisions. The parent, guardian or legal representative of any other natural person shall have the right to make health care decisions for that person.

(b) Any person may pay, and a health care provider may accept, direct payment for health care without imposition of penalties or fines for doing so.

(c) The legislature may determine reasonable and necessary restrictions on the rights granted under this section to protect the health and general welfare of the people or to accomplish the other purposes set forth in the Wyoming Constitution.

(d) The state of Wyoming shall act to preserve these rights from undue governmental infringement. AND WHEREAS, the Wyoming State Legislature passed legislation in 2017 protecting rights of parents as fundamental rights as stated in Wyoming State Statute 14-2-206.

Wyoming State Statute 14-2-206. Protection of parental rights.

(a) The liberty of a parent to the care, custody and control of their child is a fundamental right that resides first in the parent.

(b) The state, or any agency or political subdivision of the state, shall not infringe the parental right as provided under this section without demonstrating that the interest of the government as applied to the parent or child is a compelling state interest addressed by the least restrictive means.

THEREFORE BE IT RESOLVED, that the Wyoming Republican Party supports Wyoming Law protecting the rights of the individual to control their own healthcare decisions and those of their children.
BE IT FURTHER RESOLVED, that the Wyoming Republican Party supports right of parents to decide if their children will comply with requirements, such as mandatory masks, Covid19 testing, and Covid19 Vaccines, from the Wyoming Department of Health or local School Board which have to do with COVID 19 measures in taxpayer funded schools.
BE IT FURTHER RESOLVED, that the Wyoming Republican Party supports the right of every parent to send their child to school if they so choose.
